Don Fann
Mediator
Don Fann is a Florida Supreme Court Certified Circuit Civil Mediator whose mediation practice focuses exclusively on nursing home and assisted living facility cases. He received his J.D. from the University of Miami and has been a member of the Florida Bar since 1987. During the last 18 years of his career, Don concentrated almost exclusively on nursing home and assisted living litigation and served as lead counsel in numerous nursing home trials in both state and federal courts. He has handled in excess of 700 long term care cases and participated in more than 450 long term care mediations as both defense and plaintiff’s counsel. In addition to Florida, Don has litigated nursing home cases in Arizona, Georgia and Kentucky and has consulted on nursing home cases across the country.
Don spent the first half of his career litigating as a defense attorney in several different areas of the law, including auto negligence, nursing home, medical malpractice, products liability, and wrongful termination/sexual harassment. He was also in-house counsel for a large insurance company, giving him a unique and helpful insight into the claims handling process. In 2003, his practice evolved into one that focused almost exclusively on nursing home and assisted living facility cases. In 2005, Don co-founded Fann & Petruccelli, which concentrated on nursing home, assisted living, and medical malpractice defense and grew to have offices in south, central, and north Florida, as well as Phoenix, Arizona. In 2016, he became associated with a prominent plaintiff’s firm and continued to focus on matters related to nursing home and assisted living negligence. Following his tenure as plaintiff’s counsel, Don decided to transition to mediation and focus entirely on long-term care cases.
Don has an AV Preeminent rating with Martindale-Hubbell. He has been a featured speaker at national conferences addressing topics of relevance to medical practitioners in the nursing home and acute care environments, has written on related topics, including an article published in “For The Defense,” a nationwide publication produced by the Defense Research Institute (DRI). Don formerly served on the Board of Directors for the Florida Defense Lawyers Association and is admitted to the Federal Bar for the U.S. District Courts in both the Southern and Middle Districts of Florida.
